In general would a video recorded with a persons wishes for disbursement of their property, funeral details and other wishes be as good as an actual will or trust? There would be no disputing the intentions of the person unless they worded their statements poorly. Would it hold up in court if it was contested?

Any thoughts?

if the will or trust is in california, california has specific rules that must be followed in order to make a valid trust or wills. there is a code section on it, and unfortunately important parts are also mixed with other CA codes, and there is plenty of case law.

i know you can get books on how to do this yourself and google an incredible amount of information. my advice is to seek a lawyer, even consultation, there are so many tax issues/laws and numerous other pitfalls that are easy to fall into if you don't make the will or trust soundproof and a good lawyer can help you.

that said, california does allow fill in the blank wills etc...

set up a simple living trust in writing and don't mess with it....
