New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.

The ruling could alter employment practices nationwide, potentially limiting the circumstances in which employers can be held liable for decisions when there is no evidence of intentional discrimination against minorities.

"Fear of litigation alone cannot justify an employer's reliance on race to the detriment of individuals who passed the examinations and qualified for promotions," Justice Anthony Kennedy said in his opinion for the court. He was joined by Chief Justice John Roberts and Justices Samuel Alito, Antonin Scalia and Clarence Thomas.

In dissent, Justice Ruth Bader Ginsburg said the white firefighters "understandably attract this court's sympathy. But they had no vested right to promotion. Nor have other persons received promotions in preference to them."

Justices Stephen Breyer, David Souter and John Paul Stevens signed onto Ginsburg's dissent, which she read aloud in court Monday.

The Supreme Court today narrowly ruled in favor of white firefighters in New Haven, Conn., who said they were denied promotions because of their race, reversing a decision by Judge Sonia Sotomayor and others that had come to play a large role in the consideration of her nomination for the high court.

The city had thrown out the results of a promotion test because no African Americans and only two Hispanics would have qualified for promotions. It said it feared a lawsuit from minorities under federal laws that said such "disparate impacts" on test results could be used to show discrimination.

In effect, the court was deciding when avoiding potential discrimination against one group amounted to actual discrimination against another.

The court's conservative majority said in a 5 to 4 vote that is what happened in New Haven.

"Fear of litigation alone cannot justify an employer's reliance on race to the detriment of individuals who passed the examinations and qualified for promotions," wrote Justice Anthony M. Kennedy.

Justice Ruth Bader Ginsburg wrote for the liberals on the court and said the decision knocks the pegs from Title VII of the Civil Rights Act.

She read her dissent from the bench for emphasis. "Congress endeavored to promote equal opportunity in fact, and not simply in form," she said. "The damage today's decision does to that objective is untold."

The court's decision probably will lead Democrats to push efforts to have a vote on Sotomayor's confirmation so she can be in place before the September hearing, although it is unclear whether her replacement of Souter would affect the outcome of the case.

What about the poor hispanic and black firefighters who don;t get to be in charge now? Just because they aren't as smart is no reason not to give them supervisory positions. That is not in tune with the Federal government. It open a real can of worms too. Now white people who deserve promotion will start getting promoting all over the country. What a crock!!!!!

How will blacks and other minorities ever become police captains, factory supervisors and fire cheifs? Making them hold equal standards is not going to be popular with you know who too.

Police Capt, Fire Chief? That's aiming way too low. They'll have to move up the old-fashioned way: move to Chicago, get involved with a domestic-terrorist organization, do some coke, get college funding from some shady folks in return for subsequent political favors, win a congressional seat by smearing dirt on your opponent, and then BULLSHIT your way into the Presidency.

As much as I savor this victory and the hopefully ill effect it could have on Sotomayor's confirmation I find the presence of four people on the SC that voted against the decision as deeply troubling. Equality = Equality FOR ALL. not just when it's useful to further an agenda.

I akways thought filling positions should not be about filling quotas. I always thought it should be about who can do the job better - who passed the test.

It must be the fault of the firefighters who studied for, and passed the test. They are to blame for the long court case

In the midst of pretty balanced ABC, CBS and NBC evening newscast stories on the Ricci reverse discrimination case involving New Haven firefighters, who were victorious, one quibble: CBS's Wyatt Andrews framed the ruling as issued by the Supreme Court's “conservative” justices and opposed not by liberals but by “civil rights leaders,” as if the majority of justices who ruled against the racial discrimination were not advancing civil rights.

Andrews announced that “in a close 5 to 4 decision, the court's swing vote, Anthony Kennedy, sided with conservatives,” before he set up a soundbite from a representative of the NAACP: “Civil rights leaders also predicted an era of confusion over when minorities are protected and when they are not.” The NAACP's John Payton declared: “I think it hurts the cause of having a discrimination-free workplace.”

Neither ABC's Jan Crawford Greenburg nor NBC's Pete Williams applied a conservative or liberal label.

It's amazing the level of ignorance these people have. Civil rights is not exclusively patented by Blacks. Civil rights means ALL people are equal.

They took a written test that would qualify them for promotion if they passed. But, they have no right to a promotion, even though they did pass the test. Yeah, makes total sense to liberals

Ummm, no, they didn't.

They tried to promote equal OUTCOMES, not equal opportunity. In doing so, they in fact destroyed equal opportunity.

If equal opportunity were being promoted, then the people who scored highest on the test (everyone having an equal opportunity to practice, study, etc. ), would be given the promotions the city needed. Recall that the test was carefully designed to eliminate any differences between race, ethnic background, etc.

Ginsburg gets it wrong again. God help us as long as such people are on the highest court of the land.

Expect Obama to appoint more of same, and the Dem-supermajority Senate to rubber-stamp them.
