Got this in an email, and it makes alot of sense. I know we have some lawyers here, and I welcome some feedback


The 13th Amendment is very short and easy to understand.

1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

2. Congress shall have power to enforce this article by appropriate legislation.

All Involuntary Servitude is unconstitutional in the United States. This means that the Government is supposed to be protecting people and their businesses from being forced to serve anybody. Mandates from the Federal Government forcing Insurance Companies to take certain customers, whether they want them or not, is definitely a case of Involuntary Servitude.

In the United States of America, it is illegal for anybody to be FORCED into Involuntary Servitude. This does not mean that once an Insurance Company makes a contract with somebody to cover them that it cannot be enforced. If an Insurance Company failed to live up to contracts which it VOLUNTARILY entered into, this would be a case of fraud. The Government is supposed to be protecting us from fraud. But the Government is not allowed, and does not have the authority to force anybody into involuntary servitude. You get to decide whom you will, or will not, serve. Government can tell you what you cannot do to somebody else, but it may not tell you what you must do FOR somebody else. I.E. Socialism and Communism are illegal in the United States.

If you're thinking to yourself that you can find examples of the Government already forcing people into Involuntary Servitude, you are correct. All Government Social Welfare Handout Programs violate the 13th Amendment by putting the Taxpayer in a position of Involuntary Servitude to those who are receiving the handouts. But adding a Pre-Existing Condition Mandate to a long list of unconstitutional laws, does not make this unconstitutional law any more constitutional. We've just been asleep at the wheel as the Government has been breaking the law and violating Liberty. But there is no time like the present to start turning this around.

While you are calling you Congressmen and telling them not to vote for the Health Care Takeover, make sure that you inform them of the 13th Amendment's prohibition on Involuntary Servitude. Then remind them of their oath of office to uphold the Constitution. Let them know if you are interested in looking into what the ramifications are for violating their oath of office.

It makes a lot of sense. The Radical Republicans had their act together, and it shows when they wrote this. I suggest we get in tune with those inglorious bastards again. :salute:

You found an instance where Democrat plans violate the Constitution???

Imagine that.

If this one wants to get fixed, it's going to have to take a number and stand in a very long line.

I would not apply that article of the Cornstitution to insurance companies, as they are free to go out of bidness, (which is clearly the dim wit Democrat plan to install their version of Central Corntrol), as insurance without "pre existing corndition exclusions" is not insurance anymore at all.

The provision of forcing people, (American citizens) to buy health coverage or face fines or jail as dictated by Nanny Gubment is a much MUCH bigger deal, IMHO.

The problem is the sheer degree of abuse that would occur. No one would buy insurance anymore until they're already sick, and then they'd only get it until they're better, and drop the insurance.

It is unconstitutional to make individuals purchase something that they do not want or need. Young people especially are going to get the short end of the stick with Obamacare.

If Obamacare passes, I would imagine that there will be plenty of lawsuits filed contesting its constitutionality. The Republicans are promising to repeal Obamacare if it becomes law and if they become the majority party in Congress.
