An Oakland, Calif., woman and her long-term partner wanted to start a family.She did not want to have heterosexual intercourse, nor did she want to use a medical intermediary -- like a sperm bank or doctor -- and pay a fee to get pregnant.
Instead, she wanted to use a free sperm sample from a man she had chosen, and inseminate herself.

However, FDA regulations state that "any establishment that performs one or more manufacturing steps" for donating sperm samples -- from producing a sample, having it analyzed, storing it, to providing it to a recipient -- must register with the agency and get tested for communicable diseases that may be transmitted through artificial insemination.These regulations may also apply to uncompensated donors, like the one she and her partner sought out.

After the recent cease order issued by the FDA to Trent Arsenault (http://abcnews.go.com/Health/sperm-donors-women-pregnant-free/story?id=14691895#.T_3jEcjCbTo), a free sperm donor from Acampo, Calif., ordering him to stop "manufacturing" and supplying couples with sperm who are seeking to get pregnant, the woman wanted to err on the side of caution.
As a result, she is suing, under the name Jane Doe, the commissioner of the U.S. Federal Drug Administration (FDA) and the secretary of the U.S. Department of Health and Human Services, claiming its regulations violate her rights to privacy for telling her how she should be allowed to conceive a child.

How is Trent supposed to stop "manufacturing" his sperm?-:laugh:
Shouldnt they have ordered him to stop supplying it as a product instead?
If he is not charging, the customer/friend not paying (no commerce, interstate or otherwise:laugh:) ,by what authority/right do they order anything of him?
A perfect example of how a government agency oversteps its bounds and most Americans think its just doing its job.
If two lizzies want a friend to jerk off in a tube give them the sperm it is not anybody's business what they do with it, except the three of them! Is the government's position that they own the man's sperm?
All questions that show how ridiculous that the regulations from certain government agencies can often be.
We can find out how bad when the IRS becomes the Gestapo here, coming soon thanks to obamacare. That way obama gets his force equal to the military in power and funding. At least it will become so when the military is cut back to the level he'd like and the IRS healthtax collecting arm is increased to the level he'll try to push it if given a second term.
By the way with that authority they assumed , why dont they just order the illegals to stop supplying sperm to birth the anchor babies? -:laugh:

This is madness.

Obviously she should just shut up and make it happen however these women do that.

Her wanting to make a federal case out of it means she is publicity seeking or cause promotion (what the cause is is not really obvious!) or basic histrionic personality.

I think we discussed the Arsenault case here a little while back and this is the real "war" and it is happening under Obama's watch.
This is complete insanity. A man can legally deliver sperm to a consenting woman through intercourse but do the same by hand and a cup and the Feds come after you?

As for this particular woman and her preemptive case against the FDA, I say good for her.
As liberals like to say, "we need to bring awareness to the injustice against women perpetrated by the Federal Government"

Seriously, how much does it cost to get a sample of sperm???????

If this woman, or any woman for that matter, is willing to take sperm from an annonymous man from the internet that it's on her if there are any defects or hereditary disorders.

Why is the gov. involved in this???????

If this anonymous woman wants the sperm. I say give it to her.
And, if she or her partner become pregnant.
Someone should arrest her for Child Abuse...IF...that sperm happens to be tainted with HIV, or some other Disease.

This is just more of the madness of the Under-educated, and Un-educated who were turned loose by the likes of CLINTON, and now OBAMA.

The laws of man, and women are being ignored. And those who pretend that those laws are unjust, unfair, insulting, and offensive SHOULD PAY later.
This is part of the demands by THE FEW who want AMERICANS to pay for Birth Control.

See, that's the insanity about the Arsenault case. Apparently the only way to legally transfer sperm from a man to a woman is through private intercourse or a government regulated institution.
Anything else and the Feds start going after people.

As very many women have done in the past. However, that usually means that the donor is known to the woman. Issues regarding biological paternity might arise later. I wonder if this is actually more to the benefit of the donor??

No way Nell. That's how we got into all of this trouble here in the USA in the first place. It's how Obama was conceived, just before the Turkey was done in the oven. That baster came in handy for a totally different kind of Dinner.

Actually looking at this a little further it seems to be just a form of activism and protest (and yes...to protect the donor in a round about way). Apparently the FDA shut down a popular sperm donor that catered to lesbian couples and advertised his services via Facebook and his Webpage (for free).

Due to his 'services'...the FDA considers him a buisness and they require certain standards to protect the public from disease. Even though he 'claims' his donation of sperm should be considered just 'a sex act'...the FDA doesn't see it that way and shut him down. The man in question is looking at 100k worth of fines and a year in prison if he doesn't cease sperm donations.
