Joe Lozito updates us with the latest from this case against the NYPD and city of New York. Two years ago Lozito was attacked by a man in the NYC subway who was on a rampage killing people throughout the city. Lozito managed to take the man down but while doing so suffered multiple stabbing wounds, mainly to the head. While this was taking place, there were 2 NYPD officers watching nearby who only stopped in once the man was disarmed, they then later took credit for the apprehension. Lozito filed charges against the city for the officers not taking any action and the city is now claiming that they have no legal duty to protect any members of the public. Lozito explains what has happened since he filed charges and what he plans to do next.

It later turned out that Howell and fellow officer Tamara Taylor, who were part of the manhunt looking for Gelman, had locked themselves in the front room with the conductor because they thought Gelman had a gun.http://gothamist.com/2013/01/27/city_argues_nypd_had_no_special_dut.php

That's a ludicrous excuse, besides the fact that guns are forbidden in NYC (thus, how could he have one?), under the auspices of reducing gun crime, the stop and frisk law allows for a search without even suspicion. Yet when one is suspected of having a firearm, they hide to protect the public. Its so asinine, I feel stupider for having been exposed to this. :unsure:

It's not just NY, it really is protection for all city workers, including the police, fire, etc. They do not have to risk their own lives to protect an individual, not even if being told by 911 operator that 'help is on the way.'

Now we all know that policemen and firemen regularly do put their lives in jeopardy, but their oath is protect 'the public or community,' not individuals. Meanwhile people are lectured not to arm themselves, as the police are there to protect them.

If the whole train car of passengers had started pounding on the murderer, the police would have been obligated to leave the protected area and respond-the 'public' would be acting as a mob.
