I was reading about Bowe Bergdahl this morning, the article linked below. His status now being changed to "active duty". I'm hoping this is done so for them to prosecute, that they aren't naively thinking people will forget. Anyway, article 2 of this code of conduct. I'm throwing out 2 different sources. From what I hear from his own brothers in arms, he falls under article 2 and should go to prison at the very least.

Military Code Of Conduct

The Code of Conduct is a six-article code that provides general guidelines for the daily conduct of all United States military personnel. It is especially applicable at times of war or imprisonment.

(1) I am an American, fighting in the forces which guard my country and our way of life. I am prepared to give my life in their defense

(2) I will never surrender of my own free will. If in command, I will never
surrender the members of my command while they still have the means to
resist

(3) If I am captured, I will continue to resist by all means available. I will
make every effort to escape and aid others to escape. I will accept neither parole nor special favors from the enemy.

(4) If I become a prisoner of war, I will keep faith with my fellow prisoners.
I will give no information or take part in any action which might be
harmful to my comrades. If I am senior, I will take command. If not, I will
obey the lawful orders of those appointed over me, and will back them up in
every way

(5) When questioned, should I become a prisoner of war, I am required to give
only my name, rank, service number, and date of birth. I will evade answering
further questions to the utmost of my ability. I will make no oral or written
statements disloyal to my country and its allies or harmful to their cause.

(6) I will never forget that I am an American, fighting for freedom,
responsible for my actions, and dedicated to the principles which made my
country free. I will trust in my God and in the United States of America.

Article II

I will never surrender of my own free will. If in command, I will never surrender the members of my command while they still have the means to resist.

Explanation: Members of the Armed Forces may never surrender voluntarily. Even when isolated and no longer able to inflict casualties on the enemy or otherwise defend themselves, it is their duty to evade capture and rejoin the nearest friendly force.

Surrender is the willful act of members of the Armed Forces turning themselves over to enemy forces when not required by utmost necessity or extremity. Surrender is always dishonorable and never allowed. When there is no chance for meaningful resistance, evasion is impossible, and further fighting would lead to their death with no significant loss to the enemy, members of Armed Forces should view themselves as "captured" against their will versus a circumstance that is seen as voluntarily "surrendering." They must remember that the capture was dictated by the futility of the situation and overwhelming enemy strengths. In this case, capture is not dishonorable.

The responsibility and authority of a commander never extends to the surrender of command, even if isolated, cut off, or surrounded, while the unit has a reasonable power to resist, break out, or evade to rejoin friendly forces.

What Military Personnel Need to Know: Specifically, Service members should:

Understand that when they are cut off, shot down, or otherwise isolated in enemy-controlled territory, they must make every effort to avoid capture. The courses of action available include concealment until recovered by friendly rescue forces, evasive travel to a friendly or neutral territory, and evasive travel to other prebriefed areas.
Understand that capture does not constitute a dishonorable act if the service member has exhausted all reasonable means of avoiding it and the only alternative is death or serious bodily injury.
Understand and be confident in their ability to stay alive using survival skills while evading, the procedures and techniques of rescue by search and recovery forces, and the procedures for properly using specified evasion destinations.

Special Provisions for Medical Personnel & Chaplains. No additional flexibility. However, medical personnel and chaplains are subject to lawful capture. They may only resort to arms in self-defense or in defense of the wounded and sick in their charge when attacked in violation of the Geneva Convention. They must refrain from all aggressive action and may not use force to prevent their capture or that of their unit by the enemy. It is, on the other hand, perfectly legitimate for a medical unit to withdraw in the face of the enemy.

Former POW Bergdahl set to return to active duty

WASHINGTON (Reuters) - U.S. Army Sergeant Bowe Bergdahl is transitioning to regular active duty status, having completed therapy and counseling following his return from captivity in Afghanistan, the Defense Department said on Monday.

Bergdahl, who was released in May after five years as a Taliban prisoner of war in Afghanistan, is being assigned to work at the Army North headquarters at Fort Sam Houston in San Antonio, the department said in a statement.

"He will now return to regular duty within the command where he can contribute to the mission," it said.

Officials characterized the move as "the final phase of the reintegration process."

It is very possible that Obama has intervened to prevent a court martial for desertion, which everyone already knows he admitted to in writing.

The military doesn't like to air it's dirty laundry anyway, but there's too much interest in this particular soldier to do anything privately. I think they'll nail him to the wall after his counselling is complete, which is proper - if Obama hasn't interfered for political reasons, of course.

Peoples emotion cost life, as the searching for his life cost human life including the release of terrorists - I think returning someone to active duty instead of serious trail(Can be death penalty in some cases?) is very wrong.

We haven't executed a deserter since WWII. He'll most likely spend a long time in a military prison after conviction.

Jim. Though I agree with your words above In Spirit. I suspect he will get a COURT MARTIAL, and it will be very difficult to prove HE DESERTED.
Personally. Knowing the way the Obama admin, and Holder tend to handle, or overrule things. I expect they will declare he was ONLY "AWOL" (Absent Without Official Leave).
I believe they will overlook the CODE OF CONDUCT...in fairness to the man since Obama, and Holder have been giving KNOWN, CAPTURED TERRORISTS access to our COURT SYSTEM, under the Constitution.

It pisses me off as a Veteran who would have demanded a FIRING SQUAD for the Crybaby who wasn't happy, and left his fellow Americans in danger...DURING WARTIME conditions.

But then. Considering how OBAMA, and CONGRESS have allowed the V.A. to abuse WE VETERANS. Obama won't listen to us because we know HE'S AS LOW AS Bergdahl.
