That has been a nationwide industry standard for a great many years. It has nothing to do with California.

I think any company that requires their new employees to sign a non-compete contract should also be required to NOT hire anyone that has worked in their industry for the last two years. This would make it a fair exchange in that they are also not hiring someone with trade secrets that just happened to come from a competing company that did not required a contract.

One of the greatest, or best advantages California has is...that those who stay in California do not CONTAMINATE the rest of the nation with the Liberalist Agenda of Ignorance.

Georgia was even better than California until 2012 in that the employee could collect damages for restraint of trade if given a non-compete to sign. The small claims limit is GA is $15K. I had a former employer in suburban Atlanta remind me of a non-compete. I sent them a copy of my $15K claim before filing it, giving them 48 hours to cancel the non-compete. They complied.
