LOS ANGELES (Reuters) - A California defense attorney and three state highway patrol officers were arrested on Friday in connection with the 2012 killing of a man thought to be stealing scrap metal and other items from private property, police said.

A total of nine people were arrested near the city of Modesto, about 92 miles (68 km) east of San Francisco, on a string of charges related to the murder of 26-year-old Korey Kauffman, according to the Stanislaus County sheriff's office.

Criminal defense attorney Frank Carson, who last year made an unsuccessful run for Stanislaus County district attorney, was named as ringleader of the plot and charged with first degree murder, conspiracy and the special circumstance of lying in wait, which could qualify for the death penalty under California law.

The probable cause arrest warrant describes Carson as an easy-to-anger property owner with no respect for law enforcement who was hoping to send a message to thieves targeting his belongings.

Carson accused Kauffman of stealing items from a property he owned in Turlock, where he stored antiques, scrap and cars.

Kauffman was known locally for "scrapping," or stealing metal to sell to recyclers, according to the Sacramento Bee.

Carson had complained to authorities about his missing property and had confronted Kauffman, who did not deny his involvement, the arrest documents said.

Kauffman went missing in March 2012. His remains were found by hunters in a remote area of Mariposa County in August 2013. Witnesses said he was beaten to death.

Among those arrested on Friday were Carson's wife, her daughter, and three other associates.

Carson's attorney told the Sacramento Bee his client looked forward to fighting the allegations in court and clearing his name.

California Highway Patrol officer Walter Wells also faces charges of murder, conspiracy and false imprisonment. It was unclear how he intended to plead. He could not immediately be reached for comment.

According to the arrest documents, Kauffman's body was dumped in the woods by a police car, witnesses told investigators.

Two other officers, Scott McFarlane and Eduardo Quintanar Jr., were charged with criminal conspiracy and being an accessory.

The two officers could not immediately be reached for comment about the allegations.

“The California Highway Patrol is a very proud organization that values integrity," CHP Commissioner Joe Farrow said at a Friday press conference, the Modesto Bee reported. "To hear news like this is devastating."

Sounds like southern justice to me. Kauffman stole from the wrong person.

Cali justice, cop justice but not any Southern justice I know of my friend. Stealing scrap metal is petty theft.
Nothing to kill a man over, maybe stomp his ass pretty good but murder--no way.
I stared back in early 70's , I'd never live in Cali--wise choice on my part as the last 42 years has proven.
Had a girl beg me to move there with her back then and she was a stone cold fox(!) but a little voice told me--hell no!
I listen to that inner voice and have done so hundreds of times since then , tis why I am 61 years old now, lived a very , very wild young life and am still above ground! Tyr

Get real, tyr. If this dude tried to steal anything from you (petty or not), he would be just as dead.

Sounds like they did this Old School.

There's been plenty of thieves that have disappeared around here... the usual reaction to a known thief going missing is a shrug. He knew the risks, and people get shot for less.


A few years ago, I found my brand new Stihl chainsaw missing at the cabin. When I started looking around, I noticed other things missing - spices, the broom & dustpan, couple boxes of matches, some other foodstuffs... the missing stuff pointed to someone living out there, and not one of us that recreate out there. I saw my neighbor at one of the fishing hotspots later that weekend, so I swung the boat in, anchored next to him and asked him if he'd noticed anything missing from his place.

He told me he did, and he had proof as to whodunnit. He was smart and had set up a Game Cam in plain sight facing his cabin, and then installed a hidden one that covered both the obvious cam and the cabin. Sure enough, the hidden one took a bunch of pictures of a guy walking out of the woods, coming up behind the obvious cam and disabling it, then going in and "shopping", then re-enabling the cam when he left with both arms full and a backpack. Turns out he was living on a nearby lake a couple miles away through the woods.

A couple of days later, an Alaska State Trooper friend of my neighbor's dropped in via floatplane to pay the thief a visit. The thief was told that there was pictures & video of him stealing, and if anything else ever came up missing in the area that HE would probably end up missing as well - and the cop told him that he wasn't going to come try to find him. Then he got back in his plane and left.

We haven't had anything come up missing since then.

I work my ass off for what I have. I hate thieves.

Contrary to what many may believe I often have some compassion in my heart. True, I dearly hate thieves but I do my best to dish out punishment appropriate to the crime its being delivered for.
Petty theft, a solid dam good ass stomping and yes have delivered several to people that stole something from me (including a few that tried to steal--my girlfriends).
My friend, you are not likely to find a guy more real and more honest than am I.. ;)-TYR
