I concur!

As I see things, the US Constitution has won two in a row.
1st when the Senate voted against "secret" lists vs due process
2nd when the ruling against the illegal power grab by "El Jefe" regarding immigration was upheld.

Is THAT why he was whining tears all over my TV this morning? I was wondering what he was prattling on about. That dude is the biggest crybaby in the world when he doesn't get his way.

Barely. It was a 4-4 decision meaning the tie went to the lower court.

Are you say the Supreme Court rejected to hear the case? That's the only way it get's kicked down.

Nope, the tie with the 8 member court, let's the last ruling stand. If Scalia was still there the tie wouldn't have been a tie.

Exactly. Even if he were a 5-4 decision still wouldn't be a smack down.
