Pence: Trump Team Will Get Roe v. Wade Overturned

Mike Pence said Roe v. Wade, the U.S. Supreme Court decision legalizing abortion, will be overturned after Donald Trump is elected president in November, Mlive.com reported.

Answering a question from an audience member during a town hall in Grand Rapids, Michigan, the Indiana governor said a Republican win in the fall will lead to changes in the nation's highest court.

"(I) couldn't be more proud to be standing shoulder to shoulder with the next pro-life president of the USA," Pence told the southwest Michigan audience. "I believe we'll see Roe v. Wade consigned to the ash heap of history where it belongs."

The immediate balance of the Supreme Court does hang in the balance because Republicans decided earlier this year not to hold hearings for President Barack Obama's pick to replace Justice Antonin Scalia, noted The Washington Post.

Scalia, a strong conservative, died in February and Obama nominated U.S. Appeals Court Judge Merrick Garland to replace him. The court has had eight justices since Scalia's death.

Roe v. Wade won't be overturned due to the Court's doctrine of stare decisis. Since Roe v. Wade (1973), the Court has continually found for abortion. For example, Gonzales V. Carhart (2007), which upheld partial birth abortion; and most recently, Whole Woman’s Health v. Hellerstedt (2016), which overturned the limitations Texas place upon abortion providers.

As for a new judicial review of abortion based upon changing social issues, the current and anticipated social morays of the country as well as the continued actions of Congress firmly establish the legality of abortion. The Congress will have to amend the Constitution in order to ban abortion, as it did with alcohol.

The religious freaks in Congress will bring Sharia Law to the forefront of United States jurisprudence, that will be the result of their arrogant meddling.

Similarly, this is what I stated about GW many years back, and then of course Obama, and now things in discussion about whomever may get into office in 2016. There are certain things where it's simply the job of congress and not that of the president.
