Justices Rule Police Do Not Have a Constitutional Duty to Protect Someone

WASHINGTON, June 27 - The Supreme Court ruled on Monday that the police did not have a constitutional duty to protect a person from harm, even a woman who had obtained a court-issued protective order against a violent husband making an arrest mandatory for a violation.

The decision, with an opinion by Justice Antonin Scalia and dissents from Justices John Paul Stevens and Ruth Bader Ginsburg, overturned a ruling by a federal appeals court in Colorado. The appeals court had permitted a lawsuit to proceed against a Colorado town, Castle Rock, for the failure of the police to respond to a woman's pleas for help after her estranged husband violated a protective order by kidnapping their three young daughters, whom he eventually killed.

jimnyc. I once heard that the city in CA where Clint Eastwood was mayor, had a law that it was ILLEGAL to eat an Ice Cream Cone on the street, or in public on SUNDAY!

In Pennsylvania, I grew up during the time when they observed BLUE LAWS, and stores were required to remain closed on Sunday, and spitting on the street could get you fined.

DICKSON CITY -- There are laws several hundred years old on the books in Pennsylvania that are quite the head-scratchers.

That's why lawmakers are working to repeal some of those laws, nicknamed "blue laws."

"It's a very old law that dates back to people resting on Sunday and people going to church on Sundays," said Casey Medeiros, who works at the family Gibbons Ford dealership in Dickson City.

One of the blue laws still on the books is that car dealerships cannot sell cars on Sunday.

"You can't finalize any paperwork or anything dated for a Sunday," added Medeiros.

The "Stupid Motorist Law" cited in the OP is also law in TX. I will argue though the only stupid part of it is the motorist. EVERY TIME it rains ... the low water crossings are the same, in the same places. The same thing happens each time motorists dodge the barricades and get stranded or swept away.

If you have to be rescued here, you foot the bill for YOUR stupidity. I consider it one law that makes perfect sense.
