OAN Newsroom
UPDATED 9:11 AM PT — Tues. February 6, 2018The Nunes memo and a declassified report from the NSA are raising questions over the actions and motivation of Obama-era FISA judges.
The House Intelligence memo, released last week, revealed rampant abuse of the FISA mandate by the court, allegedly violating Fourth Amendment rights.
The GOP memo is also backed by a recent declassified report from the NSA, revealing that FISA court warrants were issued with procedural violations over the past several years.
This raises questions over the nature of actions undertaken by the Obama administration.
“Anytime that you spy on American citizens there needs to be an unbelievable high bar and we have to make sure that our Fourth Amendment process is certainly secure and intact,” stated Representative Mark Meadows.
FISA, or the Foreign Intelligence Surveillance Act, was established back in 1978, and is aimed at protecting U.S. national security.
The FISA court is comprised of 11 judges, serving on the panel a maximum of seven years.
The reported violations took place back in 2016, when the entire FISA court was made up of judges appointed during the Obama presidency.
According to the NSA report, a stunning 85-percent of searches sanctioned by the FISA court under the Sections 704 and 705-B violated privacy protection laws.
The NSA report also revealed that the Obama-era FBI and DOJ searched Americans against constitutional protections, and released the obtained information to outside contractors.
Some speculate opposition research firm Fusion GPS was allegedly among these contractors, and may have used some information obtained through illicit surveillance over the 2016 Trump campaign to manufacture the fake Trump dossier — paid for by the DNC and Hillary Clinton.
The GOP memo has revealed the Obama FBI and DOJ applied for and received surveillance warrants from the FISA court based off unverified information from Democrat groups without disclosing the sources of information on the application.
GOP lawmakers say such actions are punishable by up to 10-years in prison, and are urging to prosecute the Obama officials responsible for the suspected wrongdoing.
Additionally, Judge Rudolph Contreras, who is an Obama appointee, recused himself from the criminal case of former National Security Adviser Michael Flynn for an unknown reason.
It also remains unknown whether Judge Contreras signed off any of the aforementioned FISA warrants.
The NSA report, along with the GOP memo, support President Trump’s case of draining the swamp of deep state corruption and Democrat machine politics at the highest levels of the U.S government.

Guess they're REALLY going to hate Nunes now. Probably a Russian AND Chinese spy now. 85% of searches issued under FISA in 2016 violated privacy protection laws? Wonder what Schiff is going to cry now? May he needs an "adendum counter memo"

The court's judges[28] (https://en.wikipedia.org/wiki/United_States_Foreign_Intelligence_Surveillance_Co urt#cite_note-31) are appointed solely by the Chief Justice of the United States (https://en.wikipedia.org/wiki/Chief_Justice_of_the_United_States) without confirmation or oversight by the U.S. Congress.[29] (https://en.wikipedia.org/wiki/United_States_Foreign_Intelligence_Surveillance_Co urt#cite_note-Salon20130709-32) This gives the chief justice the ability to appoint like-minded judges and create a court without diversity.[30] (https://en.wikipedia.org/wiki/United_States_Foreign_Intelligence_Surveillance_Co urt#cite_note-33)[31] (https://en.wikipedia.org/wiki/United_States_Foreign_Intelligence_Surveillance_Co urt#cite_note-34) "The judges are hand-picked by someone who, through his votes on the Supreme Court, we have come to learn has a particular view on civil liberties and law enforcement", Theodore Ruger, a professor at the University of Pennsylvania Law School (https://en.wikipedia.org/wiki/University_of_Pennsylvania_Law_School), said with respect to Chief Justice John Roberts (https://en.wikipedia.org/wiki/John_Roberts). "The way the FISA is set up, it gives him unchecked authority to put judges on the court who feel the same way he does."[29] (https://en.wikipedia.org/wiki/United_States_Foreign_Intelligence_Surveillance_Co urt#cite_note-Salon20130709-32) And Stephen Vladeck (https://en.wikipedia.org/wiki/Stephen_Vladeck), a law professor at the University of Texas School of Law (https://en.wikipedia.org/wiki/University_of_Texas_School_of_Law), added, "Since FISA was enacted in 1978, we've had three chief justices, and they have all been conservative Republicans, so I think one can worry that there is insufficient diversity.

Roberts remains neutral, gleaning what is Constitutional and what is not.

Only liberals accuse him of bias if his direction does not suit them

Aaaahh yes, the same Roberts that called the unconstitutional obamacare penalty a "tax." Oh yeah, he's a real winner.

That surely excuses the FISA court from refusing less than .3% of all spying requests over the last three decades. They've basically rubber stamped every request ever made. There definitely a need to take a look at these judges, whoever appointed them, doesn't matter.

I am less concerned with who appointed who than I am it's a practice that needs to be stopped. Personally, if you are spying on me, you are one bored MFer. The principle of the it matters. The government does not have the Right to spy on its citizens without just cause. Rubber stamping warrants is UNSAT. Period.

You quote two people yet you don't pluralize liberal.

You didn't capitalize the first letter of your sentence either or use a period at the end of it.

For pretending to be so smart, you type like a dumbass.

I have to guess that the simple "probable cause" idea went out the window with these 'monitoring's'...
As well as 'justifiable evidence'...

liberals sure know how to manipulate a system...<--rarely give them a capital "L"....they do not deserve it.

But you do know that I was responding to our newest member of the leftist troll brigade...
