Trump has offered quite a bit regarding DACA recipients and other concessions to what they want. He is willing to do this in return for funding. If they don't - he is going forward anyway, and then they get nothing in return. Will it be challenged in court? Yup. Will it stop him? Not sure, but I like the odds if/when it makes it to the new SC makeup.

President Donald Trump and White House Press Secretary Sarah Sanders sent a one-two message to the Democrats Friday night warning them that Trump intends to build a border wall with or without them, implying that Trump is prepared to issue a declaration of a national emergency if Democrats continue to block funding for a border wall.
The messages came as the administration is dealing with the fallout from Trump agreeing to the Democrats’ demand that he agree to temporarily reopen the government without funding for the wall before they would negotiate funding border security.
Trump spoke first via Twitter, “I wish people would read or listen to my words on the Border Wall. This was in no way a concession. It was taking care of millions of people who were getting badly hurt by the Shutdown with the understanding that in 21 days, if no deal is done, it’s off to the races!”

Sanders soon followed, tweeting over Trump, “In 21 days President @realDonaldTrump is moving forward building the wall with or without the Democrats. The only outstanding question is whether the Democrats want something or nothing”

President Trump Repeats Threat to Shut Down Government or Use Constitutional Powers to Build Wall
President Trump caved to pressure and reopened the US government on Friday following the 36 day partial shutdown.
Trump threatened to shut down the government again in three weeks if a deal is not made to build a border wall. President Trump added that he will use constitutional powers to build the wall if he has to.
Trump tweeted this out on Friday.
