As you know, there have been endless debates about getting the vaccine. Approximately about 173 million initial (1s) shots have been given out & approximately 142 million have been fully vaccinated. And many have chosen not to get vaccinated & that is fully their right. Everyone has their own reasons and that's ok with me.

But then you have certain settings and certain employers that are requiring the vaccine to continue employment. Usually in companies where employees are facing and working with the public non-stop. And usually places where this contact is up close and personal.

Like hospitals & doctors offices. Doctors, nurses & others that will work with patients. And quite frankly, that makes sense to me and I would support that. They are paying you good money, and you are in their house under their rules. They don't want to create liability.

It's bad enough when someone refuses and then end up getting terminated. But then to sue them?

Judge Tosses Nurse’s Vaccine Requirement Lawsuit Against Houston Methodist Hospital

A federal judge tossed a lawsuit filed by a nurse against Houston Methodist hospital over its requirement that all employees be vaccinated against Covid.

117 employees filed a lawsuit against a Houston-area hospital over its Covid-19 vaccine mandate.

Jennifer Bridges, a registered nurse at the hospital said that doctors are being forced from their practices and ultimately left with no choice but to abandon their patients.

The lawsuit argued the vaccine mandate violates the Nuremberg Code and US statutes that allow Americans to refuse “unapproved” treatments.

The employees sued The Methodist Hospital, the Methodist Hospital System and Houston Methodist The Woodlands Hospital.

David Bernard, the CEO of Houston Methodist San Jacinto Hospital told employees that they can find a job elsewhere if they refuse the experimental Covid vaccine.

“100% vaccination is more important than your individual freedom. Everyone [sic] of you is replaceable. If you don’t like what your [sic] doing you can leave and we will replace your spot,” Bernard told the employees.

U.S. District Judge Lynn Hughes of Houston, a Reagan appointee tossed out the lawsuit on Saturday and blasted Jennifer Bridges.

In a scathing ruling Saturday, U.S. District Judge Lynn Hughes of Houston deemed lead plaintiff Jennifer Bridges’ contention that the vaccines are “experimental and dangerous” to be false and otherwise irrelevant. He also found that her likening the vaccination requirement to the Nazis’ forced medical experimentation on concentration camp captives during the Holocaust to be “reprehensible.”

Hughes also ruled that making vaccinations a condition of employment was not coercion, as Bridges contended.

“Bridges can freely choose to accept or refuse a COVID-19 vaccine; however, if she refuses, she will simply need to work somewhere else. If a worker refuses an assignment, changed office, earlier start time, or other directive, he may be properly fired. Every employment includes limits on the worker’s behavior in exchange for remuneration. That is all part of the bargain,” Hughes concluded.

Jared Woodfill, a Houston lawyer representing Bridges and the other clients, promised an appeal.

“All of my clients continue to be committed to fighting this unjust policy,” Woodfill said in a statement. “What is shocking is that many of my clients were on the front line treating COVID-positive patients at Texas Methodist Hospital during the height of the pandemic. As a result, many of them contracted COVID-19. As a thank you for their service and sacrifice, Methodist Hospital awards them a pink slip and sentences them to bankruptcy.”

More than 170 Houston Methodist Hospital employees have been suspended for two weeks without pay for refusing the Covid-19 vaccine.

Even if I had the vaccine, that attitude would make me want to seek employment elsewhere.

Why is that? What part of their attitude do you have an issue with?

I believe their attitude is looking out for all of their patients to ensure they don't get anyone sick, the best they can. In such a setting, they will also have many other patients and many of them ill, or folks compromised where the infection may even kill them.

Almost all of them just want to wait for formal FDA approval of the vaccine. The mindset of the hospital is dictatorial.

And what if they do the opposite - and patients get sick? Or an elderly person get sick and it kills them? Or a cancer patient or anyone else compromised? Or worse, not only maybe getting someone sick and it may kill them - but also the possibility of the infection spreading around through a unit of compromised people.

Let them continue working under same conditions and restrictions they've been working under for last 18 months until the vaccines are no longer experimental. The hospital has had these people working with sick people since the pandemic started. Why are they now demanding everyone be vaccinated? How would they be taking care of sick people if there was no vaccine?

Everyone was wearing N95 masks and a surgical on top of that in many cases. And then many even a shield on top of that. And in certain areas even full protection outfits.

I think they want to kind of get back to normal. I don't think they can continue in that manner in an unlimited fashion. In an optimal situation and they get back to normal, the resources will change & not everyone will have to wear all that protection. And again, I think the biggest issue is liability and CYA stuff.

I'm the wrong one to ask about the vaccine itself. I think, as I said, that everyone should have the right to make that decision for themselves. Fact is, it is much different than normal & has come out quite quickly as discussed. So I fully understand those not vaccinating and support their decision.

At the same though, when it comes to businesses, I've always said that they reserve the right to run it as they see fit, and 'customers' are free to shop their or elsewhere. And in the case of employees, it's the employers dime and their business and responsibilities. So they shouldn't be able to force the vaccine on anyone, and can't force it on anyone. But at the same time, the employee can either decide to get the vaccine and continue employment or decide not to and maybe choose to work somewhere else as a result. The only way I see them having a fight in this is if they have a contract and what it states about such situations.
