View Full Version : Someone hit my truck, not effing happy.

Driving my sons friend home from getting wisdom teeth pulled. Pulled up, stopped to just let him out to cross to other side of street. 10 seconds after putting it into park, turning my hazards on temporarily, and this lady backs up into me. I tried yelling out of instinct and even started to get it into drive and pull away, nothing was heard and she nailed me.

You can CLEARLY see her car parked (bronze/golden) looking little Toyota it looked like. Don't know for sure, it'll be on the police report. CLEARLY see me pull up and parked like 10 seconds before she backs into me. I tried to tell her she needs to use her fucking mirror and listen as well. She then claims I hit her! WTF? It's clear as day on the video that I didn't hit jack shit. So as police were on their way - I politely advised her - filing a false police report is a criminal offense. And when I get home and look at my camera, if it proves I did no such thing, I will then take it directly to the police to amend onto the report. Of course said video will also go to my insurance company. She doesn't have accident, only liability. Don't give a crap about her car. She needs to own up properly and my insurance will pay, and she will have to repay them/me the deductible. I told her it's her choice, be truthful and that's what insurance is for - or I take my video and play hardball. -- She told the cop she backed into me. I have to verify in 3 days that he wrote that on the report as some form of evidence - as she's liable to later claim again I hit her.

The video doesn't show the actual impact though, but again, clear I hit no one, her cars show in the video. And regardless of why I stopped to let a passenger out - she is NEVER allowed to hit a stationary object.

Anyone, foul mood prior to this for a long list of reasons. So excuse my language.

This is her car, the video will show me pulling up behind a few cars to drop nitwit off to cross over street to other side on left. Still not allowed to hit a stationary object. Try hitting a parked car whose nose is sticking into the roadway - and call police and say you hit them because they were in your way. Don't work like that.

Anyway, so there's the car on the right with proof she was there at time, not backing up...

You cannot catch a break this week. I was once backed into, by my wife's uncle, when I was parked on the side of the road waiting to follow someone to a funeral. I was told that there was a difference in fault when parked on the side of the road vs waiting in the road. This was in MI but didn't really make sense to me. NY laws may be different but any evidence you have in your favor probably beats her, "wasn't me!" You can't see the impact but it looks like you can see your truck moving from the impact, slightly in time with your cursing. You may do them the favor of bleeping out any inappropriate words. ;)

Joking aside, I'd be pissed too. She clearly threw it in reverse and rolled without looking... all 3 mirrors would have been filled with a pickup.

That cam will save you. Might even nail her for lying to the cops! False statements are illegal, you know. A she can't claim trauma confused her with that love tap into the side of your truck.

It's kinda funny listening to that kid with a mouthful of cotton try to yell out a warning, though!

No dummy, it was my sons friend, I just was giving ride home and stopping at pharmacy. I ain't had wisdom teeth for like 40 years. :smackface:

I was the one in the video talking like a sailor and he was the one mumbling through the gauze pads.

Allstate wouldn't let me send the video yet, so they only have a full explanation and like 18 photos. I fully explained the video & told them I would email it or forward a link to an agent overseeing my claim.

Will be even easier, I already got the estimate from them to repair the damage via photos. The initial estimate is just shy of $400 and could potentially change when brought to be repaired. They said if more just submit the bill. My deductible right now is only $100, so if claim is fully paid, minus $100 - I tell her to reimburse me the $100 or open a can of whoop-ass on her.

I don't mind eating the $100, just don't want to pay my damage, nor a strike of any kind on my insurance.

I thought the sound was bad, but also shows the reality of it, and as it happened. I thought maybe my reaction would help. :dunno: :thumb:

But upon reflection, telling that guy creeping forward what I did just prior to parking may not seem appropriate. It was at the time though as I hate stupid people. :laugh2:

Told you, was already in a foul mood. It progressively got worse. And then this crap.

She said I hit her at first to me. I was kind enough to warn her of consequences that could come from filing a false police report. She then changed, apologized to me, and admitted to the police that she backed into me. Things went cool from there. Just hope she doesn't call her insurance company and try anything. But that's what a dashcam is for and the police report. People often will change their minds and lie. And the way things are going lately...

Yeah, a rough love tap lets call it. This is the damage, however minor - I know it and I see it and I love my truck. I can do enough damage to it on my own though!

Molding on rear and door need to be replaced. Hard to tell from 5' away but it's there!

Why does it look like molding is slightly bent outward? Because she backed up into it and then pulled forward.

Well, Allstate paid out the claim and check is in mail and should be here before long. It's at the stage where they sent to other insurance company for reimbursement. Hopefully they will contact their insured party and things go smooth. If not, then they get the video and hopefully police report will show she fessed up. So lying could be problematic for her. Just don't want my insurance company to put some form of strike on my policy. And if they get reimbursement I also will get another 100 for my deductible back.

Picked up the police report. I'm glad it shows that she told the cop she backed up into me. It does show that I had stopped and double parked (which was just to let dumbo out of truck) so can't say if that will carry any weight.

I contend that she is not allowed to hit any stationary object no matter what, and backing up without looking first would be "unsafe backing" if she were to be ticketed. But they won't do that unless they personally witnessed the accident. Nor do I care about her getting ticketed as I just want my vehicle fixed without having to take a loss or a hit of any kind on my insurance.
