Feds: Obama Broke Law with Bergdahl Swap

President Obama violated a “clear and unambiguous” law when he released five Guantanamo Bay detainees in exchange for Army Sergeant Bowe Bergdahl, the Government Accountability Office reported Thursday.

“[The Department of Defense] violated section 8111 because it did not notify the relevant congressional committees at least 30 days in advance of the transfer,” the GAO report said. “In addition, because DOD used appropriated funds to carry out the transfer when no money was available for that purpose, DOD violated the Antideficiency Act. The Antideficiency Act prohibits federal agencies from incurring obligations exceeding an amount available in an appropriation.”

The GAO rejected the idea that the action was legal and sidestepped the Obama team’s suggestion that the law is unconstitutional.

“It is not our role or our practice to determine the constitutionality of duly enacted statutes,” the report says. “In our view, where legislation has been passed by Congress and signed by the President, thereby satisfying the bicameralism and presentment requirements in the Constitution, that legislation is entitled to a heavy presumption in favor of constitutionality.”

It should be real hard for the Executive Branch to deny Constitutionality of something the Executive Branch previously signed.

I saw this and almost posted it but thought, "hell doesn't matter anymore--Obama is excused any crime, any violation, any wrong he does because he claims to be black."
All his previous transgressions he got passes on why should this one be any different?
We have a President that usurps Congress, insults/abandons our allies, aids terrorists, institutes gun smuggling to Mexico, get Americans murdered, fails to do his duty on a daily basis , lies same as most people breathe and so dearly hates this Nation.
We have a dictatorship going on but the true powers(foreign/globalist) aren't ready just yet to swing the hammer ALL THE WAY DOWN..-Tyr

All his previous transgressions he got passes on why should this one be any different?

It could get very interesting if one of those five gets caught fighting.

As for the 'black' business, there are lots questioning Obama and Holder regarding the Ferguson issue, when a black officer shoots an unarmed white teen, will the AG come forward?

Jim. I think it's fair to say. Most of us knew...at the time. How Obama and company broke the law on the SWAP.

Like everything else Obama, and Holder have done for six years. If the law or constitution gets in their way.
