Constitutionally i think they could simply write up their own laws in line with constitutional freedoms and only enforce those.
kind of like what sates are doing with the drug laws. the feds have drug laws on the books but the state and local cops and courts just never enforced them... or give the feds any help or access in investigations and the like.
the city could simply NOT comply and unless Newsome is going to send in state troopers to enforce his BS Covid rules he's got little to nothing. (well of course blocking state money promised)
But it's always been the hidden power of the people against the gov't.
If the gov't says STAY home and all or most of the people just get up and go to work anyway what's the gov't's recourse? Jail and shoot everyone?
As corrupt as i think some cops are I don't think that would happen.
The gov't often only has as much power as we give them.
BTW : same goes for people in the military. Military folks do not have to obey unconstitutional orders. In the short term it may get called treason or insubordination if 1 person does it... or mutiny when a ship load does it.
But if a larger group does it. it's something that the brass has to call or concede to.
the military conditioning is set up to make the whole thing unlikely but it is a very real option.
