28 Million Mail-In Ballots Went Missing in Last Four Elections
Between 2012 and 2018, 28.3 million mail-in ballots remain unaccounted for, according to data from the federal Election Assistance Commission. The missing ballots amount to nearly one in five of all absentee ballots and ballots mailed to voters residing in states that do elections exclusively by mail.
States and local authorities simply have no idea what happened to these ballots since they were mailed – and the figure of 28 million missing ballots is likely even higher because some areas in the country, notably Chicago, did not respond to the federal agency’s survey questions. This figure does not include ballots that were spoiled, undeliverable, or came back for any reason.

(INDIANAPOLIS, IN.) – April 13, 2020: The Public Interest Legal Foundation (PILF) today released a research brief detailing national figures for mail balloting failures, according to previous federal surveys.
Roughly 1 in 5 ballots never completed the mail voting process in the past decade.
“Putting the election in the hands of the United States Postal Service would be a catastrophe. Over the recent decade, there were 28 million missing and misdirected ballots,” PILF President and General Counsel J. Christian Adams said. “These represent 28 million opportunities for someone to cheat. Absentee ballot fraud is the most common; the most expensive to investigate; and can never be reversed after an election. The status quo was already bad for mail balloting. The proposed emergency fix is worse.”
PILF relied on U.S. Election Assistance Commission survey data to compile national figures regarding mail ballot errors. The federal surveys reflect the 2012, 2014, 2016, and 2018 General Elections.
The EAC defines “unknown” ballots as those that “were not returned by voter, spoiled, returned as undeliverable, or otherwise unable to be tracked by your office.”

Florida’s Voter Rolls Portend Disaster for Mail-In Voting
TAMPA — As America’s most prized presidential battleground state and a focal point for increased voter turnout, Florida is ill-prepared for mail-in voting according to a new scathing report published The Public Interest Legal Foundation (PILF). Unveiled today, the analysis found that Florida’s flawed voter rolls include widespread deceased and duplicate registrants, potential for double voting, and registrants with non-residential addresses.
“Florida’s concerning registered voter lists paired with the expected surge in vote-by-mail this fall is like watching a high-speed train collision occur in slow motion,” PILF President and General Counsel J. Christian Adams said. “As a must win state for both political parties, Florida’s history with election integrity, ballot counting and voter rolls makes it particularly vulnerable to potential errors and fraud as we near Election Day. Our report’s findings will hopefully spur action by election supervisors and officials across the state to protect the integrity of the coming elections.”
Due to potential health risks posed by COVID-19, many Americans are expected to forgo their local polling precincts and choose mail-in-voting this fall to cast their ballots. The Florida report is part of a larger PILF project that collected and standardized 42 states’ voter data and marks the first of several state reports to be published in the coming weeks.
Key findings from “Is Florida Ready for the 2020 Elections” report include:
Deceased registrants — South Florida dominates in terms of deceased registrants remaining on the voter rolls, with Palm Beach, Broward and Miami-Dade among the top counties. As of October 2019:
Palm Beach: 3,656 deceased voters on list and 139 votes cast by deceased voters.
Broward: 3,339 deceased voters on list and 10 votes cast by deceased voters.
Miami-Dade: 2,323 deceased voters on list and 45 votes cast by deceased voters.
Hillsborough: 1,121 deceased voters on list and nine votes cast by deceased voters.
Orange: 1,000 deceased voters on list and nine votes cast by deceased voters.
Non-residential addresses –Nationally, during the 2018 General Election, 35,800 ballots were cast in 41 states, including Florida, from non-residential addresses. Florida was among the top ten states with 1,267 registrants on the voter roll who were later determined to either not have a residence anywhere in the state, or who were simply made up.
Double voting – 1,836 Floridians’ records indicate that they voted twice in a national election with a second vote being cast in a different state.

Thousands of North Carolina Registrants are Credited for Voting Twice by Mail
(GREENSBORO, N.C.) – July 9, 2020: The Public Interest Legal Foundation (PILF)’s amicus brief filed in a federal lawsuit to strip North Carolina’s mail voter protections in 2020 was accepted by the court Wednesday.
The Foundation’s brief outlines how even with the modest integrity mechanisms in place, public election records demonstrate how duplicated voter registrants are credited for voting second ballots in a widespread pattern across the 2016 and 2018 General Elections.
Individual records show a substantial portion of credited second votes derive from a duplicated registrant apparently casting two absentee ballots for the same election. Stripped protections atop substandard voter rolls could only exacerbate these patterns in 2020.
“This is a widespread concern in North Carolina,” PILF President and General Counsel J. Christian Adams said. “We should be talking about how to strengthen our systems against misdeeds done out of the sight of election officials in 2020 instead of defending an imperfect system from total ruin. The plaintiffs are only raising the threat of worsening the settled fact that voter fraud is most common in the mail.”
