    Default Son wins lawsuit against parents after they dispose of his porn collection

The US district judge Paul Maloney ruled in favour of David Werking, who said his parents had no right to throw out his collection. He lived at their Grand Haven home for 10 months after a divorce before moving to Muncie, Indiana. Werking said boxes of films and magazines worth an estimated $29,000 (£21,500) were missing. “There is no question that the destroyed property was David’s property,” Maloney said. “Defendants repeatedly admitted that they destroyed the property.” Werking’s parents said they had a right to act as his landlords. “Defendants do not cite to any statute or caselaw to support their assertion that landlords can destroy property that they dislike,” the judge said. Maloney told both sides to file briefs on the financial value of the collection. “The court does not intend to hold an evidentiary hearing,“ he said.

    As a parent, I may agree that sometimes tough love is needed.

    But once an adult, and fall under laws - unfortunately he was 100% correct. They had zero right and a landlord holds zero rights to destroy property or get rid of it either.

    And I may disagree with his actions, but also would have found him due the money and correct under the law as well.

    They should not have destroyed his property. However, they should have asked him to remove it ... put in storage or at someone else's house. But they had right to ask him to get it out of their house.

    Yups. As parents, I would have spoken to him first. Maybe taken it away, but with the ability to give it back. Trying to make a change in a way. Options other than destroying it.

    Now, it all depends on some factors, as parents or not there is likely a landlord tenant relationship going on here as pointed out. Did they actually write one out? And if not, was he paying anything at all? Food, utilities or anything? And then change and have his mail sent there? A month to month lease was likely created as a default. And along with that would come all the laws and regulations that come for a normal landlord in their state.

    Then, where was his dumb collection? Out in the open? Hidden, boxed?

    Then there are laws/regulations in how a landlord asks a tenant to have something cured/fixed, and giving the tenant opportunities. These things likely are what allowed a judge to go in favor of the son.

    But worse, most likely a relationship between parent and child has likely been made irreparable over porn. Was it worth it? I can state the answer now as NO whether any of them see it that way now or not.

    Divorce is likely inevitable if you're amassing a $29k porn stash on the side.

    Sounds like he got what he deserved from his wife & is now getting what he deserves from his parents. With any hope, his parents are elderly and have their finances set in a manner that makes them "uncollectable: and he won't get jack shit from them.

    From a totally legal standpoint, the son is correct. Morally and ethically, offspring is FOS. Parents should have told son to dispose of his porn or hit the road. I hope son got a lot of publicity for his court win.

    My nephew and his SO (both in there 50s) moved in with me rent free for a few months back in 2011. They agreed to help with chores around the property (2 acres) in exchange for room and board. Never had a written agreement. The SO was lazy and wouldn't do anything. Not even take care of their laundry. He did it all. I finally got fed up when she wouldn't even pick up her dog's poo and told her she needed to leave. He could stay if he wanted. I gave her 6 weeks to find a place. After a month she was still dithering around saying she couldn't find anything. She would be gone all day and I'd ask what places she looked at. She wasn't looking. She told me I couldn't just kick her out. That she was getting mail at my address therefore I had to go to court to get her out.

    My badassy self jumped out and got in her face and said "one way or another you will be out of here today with or without my help." She called my nephew and they were gone that night. I was pretty pissed off.

    Moral of the story ... she tried to be a squatter and my nephew had to remind her I don't need court system to evict her....I have connections. I didn't destroy anything but I sure wanted to.

    Porn is supposedly everywhere on the internet for free or cheap. Even if one doesn't object to porn, throwing away $29k like that takes a special kind of stupid. An just to think, a car in #5 condition is sometimes referred to as a "rolling divorce", but at least you would have something like this (or better) after spending $29k.

    People fear the silent cobra more than a roaring lion. One people witness you blindside someone when it was least expected, others will think twice before crossing you. Being a silent cobra is also better for your blood pressure. She could have suddenly found her stuff in a storage bin where you handed her the key and told her that you generously paid the first month.

    You remind me a bit of my mom. Most of the time, my mom is very calm and sedate. Comes from teaching elementary school for 25 years. But one thing my sister and I figured out early was that you don't make my mom angry. She never had to punish you. My mom has the most withering stare. Even my dad fears "the stare." Never make a German mom angry with you.

    Wow! That never crossed my mind ... getting her a storage unit.

    I never saw myself as a cobra .... more like a cougar.

    I've sent two ex husband's ex wives to emergency room though. And, both of them had 6-8" and 40 lbs on me. Both attacked me in my yard when picking up their kids. Crazy bitches. First one kicked my dog ... big mistake. Dog got quarantined and she, ex husband and I had to talk to DA because a report had to be made due to hospital visit. My dog tore up her lower leg and I tried to rip her throat out. I lost a big patch of hair she pulled out.

    Second ex wife verbally attacked my daughter who told her to quit yelling at the babies. My motherly instincts kicked in and somehow I broke her arm. Had to go to small claims court on that one. I had to pay her epically bills. It was worth it.

    I'm not the type that stands there and yells at some one. They do all the yelling and I mind my own business until they touch me or mine. So when I do go in it surprises everyone. The most surprised were the ex-husbands because I'm smaller than the exes.

    So, I'm sore my nephew reminded his SO that it was best she leave as I dictated. The sooner the better.

    Yeah ... that's me. I had 3 brothers ...2, 4 and 6 years younger.. we were at picnic. I was 18 or 19. They to pick me up and started taking me down to the lake to throw me in. At first I struggled and then I just stopped and calmly told them to go ahead. Throw me in and then run for your lives and be sure to give their heart to God because their ass would be mine. Well, they started talking about it on the walk down to the lake. I had quit struggling and talking. Just giving "the look". They put me down and none of them ever teased me again. Its all about perception.

    Your mom had that ability I'm sure.
